Guiding you safely through a forest of regulation

Living in Colorado, we see the peaks and forests of the Rocky Mountains and we value the importance of a healthy and beautiful environment.

Real and perceived environmental threats have produced an explosion of regulations from every level of government, and an increased willingness to challenge a company’s operational practices. Burns, Figa & Will, P.C. has proven competence in the distinct fields of environmental and water law – and in the many cases in which they overlap.

The combination of expertise and experience that permeates Burns, Figa & Will enables us to resolve conflicts with innovation, efficiency and effectiveness. Since many environmental conflicts attract great public and media attention, our business judgment and public relations skills are highly valued by our clients.

Environmental Law

In recent decades, environmental regulations have come to overlay business and real estate transactions. These complex, sometimes conflicting rules and regulations demand a law firm that has “been there-solved that.”

Burns, Figa & Will brings to the table proven capabilities in handling complex environmental matters:

  • Expertise in earth and environmental sciences
  • Multiple legal sub-specialties
  • Sophisticated litigation skills
  • Intimate knowledge of administrative agencies and practices
  • Negotiation savvy
  • Public relations and legislative skills

For individual and business clients

We advise clients on environmental laws and policies, contaminated property transactions, permitting issues, road and access law, and a broad spectrum of real estate-related matters. We represent clients in litigation, voluntary clean-up and brownfields transactions, multi-party clean up and governmental enforcement actions.

For government clients

We represent local, state, and federal governmental entities on everything from complex contract negotiations to litigation. We have assisted clients in drafting ordinances and polices in matters involving wetlands and endangered species, and on matters related to airport and military base closures and redevelopments.

For federal policies

We advise clients about land management policies on Forest Service and Interior Lands, including federal leases, permits, and easements; wildlife, vegetation, and cultural resources protection; forest management; environmental impact assessments and statements; wilderness designation and legislation; mining; and resource damages.

Water Law

Our experienced water law attorneys have taken part in some of the landmark cases in Colorado water law. As drought conditions in Colorado and elsewhere have made painfully clear, water issues will only increase as the population grows. Our capabilities include:

  • Representing governmental entities, agriculture, resorts, developers, and non-profit organizations.
  • Water cases, water transactions, and administrative agency matters.
  • Complex water rights transfers and “plans for augmentation”.
  • Advising on federal water policy issues such as Endangered Species Act, water quality, use of federal facilities, and reserved water rights.
